Latest Government Guidance on Distance Selling into Europe after Brexit

The Government has updated its guidance relating to online activities in the European Economic Area (EEA) from January 1st 2021.

The eCommerce Directive allows online service providers based within the EEA to operate in any other EEA country whilst only following the relevant rules in their own country. This will no longer apply to UK-based service providers from next year as the UK will have left the EEA.

This potentially affects anyone selling products and services to retail customers elsewhere in Europe.

The government is recommending that online retailers should check for any relevant legal requirements in any EEA country that they operate in, for example, rules covering online information, advertising, shopping and contracts.
